Overview
These Terms of Service ("Terms") govern your access to and use of the Facebetter software-as-a-service platform, developer SDKs, documentation, demo applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use the Service.
Definitions
- "We", "Us", and "Facebetter" refer to the provider of the Service.
- "You" and "Customer" refer to the individual or entity using the Service.
- "Account" means the user profile and configuration created to access the Service.
- "SDK" means software development kits, libraries, and code samples we provide.
Eligibility and Account
- You must be at least the age of majority in your jurisdiction to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- You must provide accurate and complete registration information and keep it up to date.
License and Acceptable Use
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and SDKs in accordance with the documentation and these Terms.
- You shall not: (i) reverse engineer, decompile, or disassemble the Service or SDKs; (ii) circumvent technical restrictions; (iii) use the Service to build a competing product; (iv) use the Service for unlawful, harmful, or infringing purposes; (v) resell, sublicense, or share access except as expressly permitted.
- You must comply with all applicable laws and regulations when using the Service.
Billing and Payment
- Some features may require payment. Fees, if applicable, are disclosed in your dashboard or order form.
- Unless otherwise stated, fees are billed in advance and are non-refundable.
- You authorize us (and our payment processor) to charge your selected payment method for all fees incurred.
- We may suspend or terminate access for unpaid or disputed charges.
Service Availability and Support
- We aim to provide reliable Service but do not guarantee uninterrupted availability.
- Maintenance, updates, or third-party outages may affect availability.
- Support channels and SLAs, if any, are described in the documentation or your order form.
Intellectual Property
- We retain all rights, title, and interest in and to the Service, SDKs, documentation, and all associated intellectual property.
- You retain ownership of your applications and content you create using the Service, subject to our rights in the underlying technology.
Data and Privacy
- Our use of personal data is governed by our Privacy Policy.
- You are responsible for obtaining appropriate consents and providing notices to end users where required.
- You must not submit sensitive personal data (e.g., health, biometric, or financial information) unless explicitly permitted and compliant with applicable law.
Third-Party Services
- The Service may integrate with third-party providers (e.g., authentication via Supabase, GitHub, Google). Your use of those services is subject to their terms.
- We are not responsible for third-party services and do not control their availability or policies.
Compliance and Security
- You must implement reasonable security measures in your applications that use our SDKs.
- Do not expose credentials, license keys, or private endpoints publicly.
- Report suspected vulnerabilities to us through the designated channel.
Beta and Experimental Features
- We may offer beta, preview, or experimental features. Such features are provided "as is" without warranties and may be changed or discontinued at any time.
Warranties and Disclaimers
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACEBETTER SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY.
- OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
Termination
- You may stop using the Service at any time. We may suspend or terminate your access for violations of these Terms or for non-payment.
- Upon termination, your right to use the Service ceases, but certain provisions (e.g., intellectual property, limitations of liability) will survive.
Changes to Terms
- We may update these Terms from time to time. Material changes will be communicated via the website or dashboard.
- Continued use of the Service after changes constitutes acceptance of the updated Terms.
Governing Law and Dispute Resolution
- These Terms are governed by the laws of the jurisdiction where Facebetter is established, without regard to conflict of law principles.
- Any disputes shall be resolved through good-faith negotiations. If unresolved, disputes may be submitted to arbitration or the competent courts of that jurisdiction, as applicable.
